When can an IDS be submitted?

a.  Within 3 months of the filing of a non-provisional application/national phase entry, or before a first office action on the merits:  No extra procedural requirements are necessary.

b.  After the time described in part a., but before a final office action, notice of allowance, or an action that closes prosecution:  You will be required to either pay an extra fee, or swear to  one of the two statements specifically listed in the statute.

c. After the time described in b., you will be required to submit both the extra fee and swear to one of the two statutory statements mentioned above.
