Robert R. Sachs has recently posted extensive amounts of data showing the effects of Alice on courts, the number of additional 101 challenges brought, the number of additional claims rejected under Alice, and a comparison of those numbers to pre-Alice numbers.
Software, not business methods, has been the target of the most number of additional challenges post-Alice. In the 32 months after Alice, the number of district court decisions involving 101 rejections has exploded approximately 10-fold, with roughly commensurate increases in the number of patents challenged and invalidated.
