How do you know whether a patent examiner has considered a reference listed within an IDS?

8/18/2017

Within the Patent Application Information Retrieval (PAIR) system, the Examiner will create a document entitled:  "References cited by Applicant and considered by the Examiner."  The IDS will be listed.

Either the Examiner will initial each reference that he considered, or more commonly, a stamp will be placed on the IDS indicating that the Examiner has considered all references listed within it except those that have been "lined out" (and the Examiner will have drawn a line through those references he did not consider).

The Examiner can also provide you this information over the phone, provided you are the Applicant or an attorney of record.
