How do I correct the situation where the figure I designated for publication is part of a non-elected species?

There are two solutions.

1.  You can cancel a figure that is part of the non-elected species.  The U.S.P.T.O. will ordinarily not publish a canceled figure. 

2.  Amend the application data sheet (ADS) to designate a new figure for publication.

NOTE:  The figure you designate for publication is just a suggestion -- the U.S. Patent Office is free to choose a different figure than the one you designated on the ADS.
