Can an amendment proposing to remove text from patent applicant's specification constitute "new matter"?
Yes. Suppose the original specification described an invention which required Element X and Element Y. Later, the Applicant proposes an amendment removing the requirement of Element X. Such an amendment would likely constitute "new matter."
